國科會修正「國家科學及技術委員會補助前瞻技術產學合作計畫作業要點」
一、依據國家科學及技術委員會115年6月22日科會產字第1150041088號函辦理。

(四)第17點:合作企業之出資若包含先期技轉授權金者,其中涉及先期技轉之研發成果,應依修正後第8點第4款第1目規定辦理,不依本點規定辦理。
(五)第19點:增訂多年期研究計畫涉及從事人體研究、人體試驗、人類胚胎及胚胎幹細胞研究者,於執行過程持續符合相關法規之規定。
(四)第17點:合作企業之出資若包含先期技轉授權金者,其中涉及先期技轉之研發成果,應依修正後第8點第4款第1目規定辦理,不依本點規定辦理。
(五)第19點:增訂多年期研究計畫涉及從事人體研究、人體試驗、人類胚胎及胚胎幹細胞研究者,於執行過程持續符合相關法規之規定。

Subject: Amendment to the Guidelines for the Advanced Technology Industry–Academia Collaborative Research Projects Subsidized by the National Science and Technology Council
The key amendments to the aforementioned Guidelines are summarized as follows:
(1) Article 5:
Relevant documents concerning research ethics review are expressly stipulated. In addition, research projects involving human subject research or clinical trials shall complete and submit a Gender Consideration Checklist for Research.
(2) Article 8
For all project categories, the matching funds contributed by collaborating enterprises may include research and development (R&D) funding provided to the applicant institution, upfront technology transfer licensing fees, and the collaborating enterprises’ self-funded R&D expenditures.
The requirements governing enterprise-provided R&D funding and upfront technology transfer licensing fees are expressly stipulated. In response to the inclusion of upfront technology transfer licensing fees as eligible matching funds, provisions have also been added, including the granting of non-exclusive licenses for a period of up to five years.
The limits on upfront technology transfer licensing fees and self-funded R&D expenditures by collaborating enterprises are as follows:
* For Advanced Technology R&D Projects, upfront technology transfer licensing fees may be budgeted, with a maximum amount not exceeding 10% of the total matching funds after deducting the collaborating enterprise’s self-funded R&D expenditures.
** For Industry-Academia R&D Center Projects and Leading Technology Development Projects, upfront technology transfer licensing fees and self-funded R&D expenditures may be budgeted, with their combined amount capped at 20% of the total matching funds.
(3) Article 15
Upfront technology transfer licensing fees are incorporated into the baseline amount of matching funds for Advanced Technology R&D Projects. In addition, collaborating enterprises’ matching contributions may be adjusted flexibly based on review results; however, the adjusted amount shall not be lower than the approved subsidy. Furthermore, the requirement that the leading enterprise contribute at least one-half of the total matching funds has been removed.
(4) Article 17
Where a collaborating enterprise’s contribution includes upfront technology transfer licensing fees, any R&D results subject to such upfront technology transfer arrangements shall be handled in accordance with Subparagraph 1, Item 4 of Article 8 as amended, rather than under the provisions of this Article.
(5) Article 19
New provisions have been added requiring multi-year research projects involving human subject research, clinical trials, human embryos, or embryonic stem cell research to maintain continuous compliance with applicable laws and regulations throughout the project implementation period.
